Acceptance of Terms
These Terms of Service (the "Terms") form a binding agreement between you and AcerOS and govern your use of AcerOS, including our website, dashboard, lead-generation and lead-extraction workflows, export features, webhook tools, the AcerOS Direct Mail service, billing interfaces, and related services (together, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy.
You must be at least 18 years old and able to form a binding contract to use the Service. If you are using AcerOS on behalf of a company, team, or other organization, you represent that you have authority to bind that organization to these Terms, and "you" refers to that organization.
If you do not agree to these Terms, do not use the Service.
Who We Are
AcerOS is a software product currently operated as a sole proprietorship in the United States (the "business," "AcerOS," "we," "us," or "our"). We may reorganize the business as a limited liability company or other entity in the future; if we do, that entity will assume these Terms and continue to operate the Service as AcerOS.

The AcerOS Services
AcerOS offers two related but separate products. The first is Lead Lists: we identify recently sold and new-homeowner property records from public and licensed third-party sources and make them available to you for your own outreach. The second is Direct Mail: an optional, prepaid service in which we help design and send physical postcards to addresses on your behalf through our print-and-mail provider.
Lead credits and Direct Mail ("mail") credits are separate, prepaid balances and are not interchangeable. Access to particular features depends on your plan, your available credits, and applicable feature gates.
Eligibility and Accounts
You are responsible for safeguarding your login credentials and for all activity that occurs under your account. You must keep your account information accurate and notify us promptly at legal@aceros.dev if you suspect unauthorized access or any breach of security.
You are responsible for everyone you allow to use your account, including team members and invited users, and for ensuring their use complies with these Terms.
We may implement security reviews, session controls, verification steps, rate limits, or other technical measures to protect platform integrity and customer data, and we may suspend or terminate accounts that create security risks, abuse usage limits, or compromise the stability of the Service.
Acceptable Use and Your Outreach Compliance Responsibilities
AcerOS is provided for lawful business use only. You agree not to use the Service in violation of any applicable law, regulation, privacy obligation, contractual restriction, or third-party platform terms.
You are solely responsible for how you contact the people and properties identified through the Service. This includes compliance, where applicable, with the Telephone Consumer Protection Act (TCPA), the federal and state Do-Not-Call (DNC) registries and rules, the CAN-SPAM Act, state telemarketing and door-to-door solicitation laws, the Telemarketing Sales Rule, and any other law governing calls, texts, emails, faxes, or in-person and mailed solicitations. Before calling or texting any number, you are responsible for scrubbing it against the applicable Do-Not-Call and litigator lists and for obtaining any consent the law requires.
You agree not to use the Service to harass, threaten, defraud, or deceive anyone; to send unlawful, misleading, or prohibited content; to target individuals based on protected characteristics in violation of fair-housing, fair-lending, or anti-discrimination laws; or to resell, sublicense, or redistribute the data or the Service except as expressly permitted by your plan. We may suspend or terminate accounts that we reasonably believe are using the Service unlawfully or in violation of these Terms.
Lead Data — Sources, Accuracy, and No Guarantee
Lead data is aggregated from public records and licensed third-party sources and is provided to you on an "as is" basis. Real-world records change, lag, and contain errors. We do not warrant that any lead, address, name, valuation, sale date, or other data point is accurate, current, complete, or suitable for your purpose, and you are responsible for independently verifying data before you rely on or act on it.
AcerOS is not a consumer reporting agency, and the data and the Service are not a "consumer report" under the Fair Credit Reporting Act (FCRA). You agree not to use the Service or any data obtained through it, in whole or in part, as a factor in establishing a person's eligibility for credit, insurance, employment, housing, or any other purpose regulated by the FCRA.
We do not guarantee any particular volume of leads, accuracy rate, deliverability, response, appointment, sale, or result of any kind.
Direct Mail Service
If you use AcerOS Direct Mail, you are the sender of record and the advertiser for every mail piece you send. You are solely responsible for the content of your mail pieces, for any claims or offers they contain, and for ensuring that content is truthful, substantiated, and compliant with all applicable laws, including the Federal Trade Commission Act, state deceptive-trade-practices laws (including the Texas Deceptive Trade Practices–Consumer Protection Act), and any industry-specific advertising rules (for example, those applicable to solar, roofing, HVAC, or home-security sales).
AcerOS acts only as a facilitator that helps design your creative and submits print-and-mail orders to a third-party mail provider on your behalf. By submitting a mail order, you authorize us to print and mail your approved creative to the addresses you select, using your verified business return address as the sender. You approve each creative before it is sent, and you are responsible for that approval.
Mail credits are prepaid and consumed per mail piece. Addresses are verified before sending; undeliverable addresses are not charged. We do not guarantee delivery, delivery time, or any response. We may decline or cancel any mail order that we reasonably believe is unlawful, deceptive, or harmful, or that violates a provider's policies.
Billing, Payments, Credits, and Refunds
Paid features require an active subscription, lead credits, or mail credits. Billing and payment processing are handled by Stripe or other authorized payment providers; we do not store your full card number. You authorize us and our payment processors to charge applicable subscription fees, one-time charges, credit purchases, taxes, and related amounts associated with your selected plan and purchases.
Subscriptions renew automatically each billing period until you cancel. You may cancel at any time from your account or by contacting us; cancellation takes effect at the end of the current billing period, and you retain access until then. On renewal, plan lead credits reset for the new period; separately purchased credit packs and mail credits are not reset by renewal and carry over, except as otherwise stated at the point of purchase.
Except where required by law or expressly stated otherwise, all fees and credit purchases are non-refundable, and credits have no cash value. You agree to resolve billing disputes with us directly before initiating a chargeback. We may change prices, plans, or credit terms prospectively; changes do not affect the billing period you have already paid for.
Intellectual Property and License
The Service, including its software, design, text, graphics, and the AcerOS name and logo, is owned by AcerOS and protected by intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes.
You may not copy, modify, distribute, sell, sublicense, lease, reverse engineer, scrape, or create derivative works from the Service or its underlying data, except as expressly permitted by your plan, and you may not use the Service to build or train a competing product or dataset.
You retain ownership of the content you upload or provide, such as your logo, brand assets, and creative inputs ("Your Content"). You grant us a non-exclusive, worldwide license to host, process, reproduce, and adapt Your Content solely to operate and provide the Service to you, including designing and printing your mail pieces. If you send us feedback or suggestions, you grant us the right to use them without obligation to you.
Third-Party Services
AcerOS relies on third-party services and infrastructure, which may include Supabase for backend and database services, Stripe for payments, Resend for email, our print-and-mail provider for Direct Mail, and standard hosting, data, logging, and analytics vendors. Your use of connected services you configure (such as CRM webhooks or payment methods) may also be subject to those providers' separate terms.
We are not responsible for outages, policy changes, errors, or failures caused by third-party services or systems outside our direct control.
Availability and Product Changes
We may modify, suspend, or discontinue features, pricing, credits, integrations, or technical architecture as the product evolves, and we may perform maintenance, provider migrations, or security interventions without advance notice.
We do not guarantee uninterrupted availability or that the Service will always be error-free, complete, or compatible with every external system.
No Professional Advice; No Earnings or Results Guarantee
AcerOS provides software and data, not legal, compliance, tax, financial, or other professional advice. Information we provide, including any guidance about outreach or marketing, is for general informational purposes only, and you should consult your own qualified advisors.
Any examples, benchmarks, or response estimates we share (for instance, typical mail response ranges) are illustrative, not promises. We make no guarantee that you will obtain any specific number of leads, responses, customers, revenue, or results, and your results depend on factors outside our control.
Disclaimer of Warranties
The Service and all data are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties as to the accuracy, completeness, reliability, or availability of the Service or data.
Limitation of Liability
To the maximum extent permitted by law, AcerOS and its owner, affiliates, and providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, business opportunity, or goodwill, arising from or related to your use of the Service, even if advised of the possibility of such damages.
To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Service will not exceed the greater of the total amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim, or one hundred U.S. dollars (US$100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
Indemnification
You agree to defend, indemnify, and hold harmless AcerOS and its owner, affiliates, and service providers from and against any claims, demands, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: your use of the Service; your outreach activities, including any calls, texts, emails, or mail you send; the content of your Direct Mail pieces and advertising claims; your violation of these Terms or any law (including the TCPA, DNC rules, CAN-SPAM, FCRA, fair-housing, and deceptive-trade-practices laws); or your infringement of any third party's rights.
We may assume the exclusive defense and control of any matter subject to indemnification, in which case you agree to cooperate with us.
Termination
You may stop using AcerOS at any time. We may suspend or terminate access if you violate these Terms, create risk for the platform, fail to pay applicable fees, or use the Service in a manner that could harm AcerOS, its users, or third parties.
On termination, your right to use the Service ends. Sections that by their nature should survive termination — including those on lead-data use, intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution — will continue to apply.
Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Before filing any claim, you agree to first contact us at legal@aceros.dev and attempt in good faith to resolve the dispute informally for at least thirty (30) days.
If we cannot resolve a dispute informally, you and AcerOS agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered under the rules of a recognized arbitration provider, seated in Texas, rather than in court — except that either party may bring an individual claim in small-claims court, and either party may seek injunctive relief in court to protect intellectual property or stop misuse of the Service.
To the fullest extent permitted by law, you and AcerOS agree that claims will be brought only in an individual capacity and not as a plaintiff or class member in any class, collective, or representative proceeding, and the arbitrator may not consolidate more than one person's claims. If this class-action waiver is found unenforceable, the rest of this section still applies, and the dispute will proceed in the state or federal courts located in Texas, to whose jurisdiction you consent.
Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the effective date above and may provide additional notice. Your continued use of the Service after changes take effect means you accept the updated Terms.
